Terms of Service

1. Who provides Cain
Cain AI (“Cain”, “we”, “us”) is provided by Ilia Prudnikov, an individual trading as Cain AI, Gang Sukun No. 3, Tibubeneng, Kuta Utara, Badung Regency, Bali 80361, Indonesia. Contact: support@cain-ai.com.
By purchasing or using Cain you agree to these Terms.
2. What Cain is
Cain is a private AI agent system that runs on a dedicated server provisioned for you. Your subscription covers:
- the Cain orchestration software and its updates
- a dedicated server provisioned, monitored and maintained for you
- guided activation and ongoing support
Cain is an orchestration layer, not an AI model. Cain is a personal productivity tool. It is not a professional adviser, and its output must not be relied on as legal, medical, financial or other professional advice.
3. What is not included — your LLM subscription
Cain requires your own active third-party AI subscription (for example ChatGPT Plus, Claude Code or Codex). You connect it during activation through the provider’s own secure login (OAuth). Your password is never shared with, seen by, or stored by Cain.
You pay your AI provider separately. We do not resell, proxy or meter model usage, and your provider’s own terms govern your use of their models. If your provider changes its terms, pricing or availability, or suspends your account, this is outside our control and does not entitle you to a refund of Cain fees already used.
Independence. Cain AI is an independent product. It is not affiliated with, endorsed by, or sponsored by OpenAI, Google, Anthropic, or Telegram. All trademarks belong to their respective owners.
4. Prices, payment and who you pay
Prices are shown on the checkout page in US dollars and are exclusive of tax: any applicable VAT or sales tax is calculated and added at checkout, so the amount you pay may be higher than the price displayed. Your first payment covers a one-time setup fee plus your first period. After that, only the recurring subscription applies.
Payment is processed in one of two ways, and this affects who your counterparty for the payment is:
- Card, Apple Pay, Google Pay and PayPal — processed by Lemon Squeezy, which acts as the Merchant of Record. Lemon Squeezy is the seller of record, issues your receipt, and is responsible for collecting and remitting any applicable VAT or sales tax. Their terms apply to the payment itself.
- Cryptocurrency — processed through NowPayments as a payment gateway. Here the sale is made directly by Ilia Prudnikov, and the payment is between you and us.
In both cases these Terms govern your use of the Cain service.
5. Subscription, renewal and cancellation
Your subscription renews automatically for successive periods until cancelled. The setup fee is one-time and is not charged again on renewal.
Card, Apple Pay, Google Pay and PayPal. You can cancel at any time and without giving a reason:
- yourself, through the Lemon Squeezy customer portal — the link to manage your subscription is in your receipt and in renewal emails
- or by writing to support@cain-ai.com, and we will cancel it the same business day
Cancellation takes effect at the end of the paid period: you keep access until it ends and the next payment is not taken. Cryptocurrency. There are no automatic charges: we do not hold your payment details and cannot take money on our own. We send an invoice for each period to your email. To stop the subscription it is enough not to pay the next invoice — nothing else is required. You may tell us, but you do not have to. Where a discounted founder rate is stated as locked, it remains for as long as your subscription stays continuously active; after a break, the then-current rate applies. If a payment is not received, we may suspend and then terminate the service and decommission the dedicated server — before that we will deliver your memory archive as described in section 7.
6. Refunds
Our Refund Policy forms part of these Terms and explains when and how you can obtain a refund. Nothing in these Terms limits any statutory refund or cancellation right you may have as a consumer under the law of your country of residence.
7. Data, memory and privacy
Cain’s memory is formed and stored on the dedicated server provisioned for you. Our Privacy Notice explains what we process and why.
On cancellation, Cain compiles your memory into a Markdown archive and delivers it to you; after delivery the dedicated server is shut down and its data deleted within 7 days. You are responsible for retrieving your archive before that period ends.
You are responsible for the content you send to Cain and for having the right to send it.
8. Acceptable use
You may use Cain for your own lawful purposes. You must not use Cain to break the law, to harm or harass others, to generate or distribute malicious code, to infringe intellectual property, or in any way that breaches your AI provider’s terms.
One Cain per person. Each subscription is provisioned for a single individual. You must not resell, sublicense, or share your Cain instance or its access credentials.
We may suspend or terminate the service, without refund of amounts already used, if these rules are seriously or repeatedly breached.
9. Availability and support
We aim to keep Cain running continuously, but we do not guarantee uninterrupted or error-free operation. Service may be interrupted by maintenance, updates, or by failures of upstream providers (server hosting, AI providers, Telegram) that are outside our control.
Support is provided by email at support@cain-ai.com and, where offered, via Telegram.
10. Intellectual property
The Cain software, brand and materials remain our property. You receive a personal, non-exclusive, non-transferable right to use Cain for the duration of your subscription. Content you create with Cain and the memory Cain forms about you are yours.
11. Liability
Cain is provided “as is”, to the fullest extent permitted by law. We are not liable for indirect or consequential loss, loss of profit, loss of data, or for output produced by third-party AI models.
Our total liability arising from your use of Cain is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
Nothing here excludes liability that cannot be excluded by law, including liability for fraud, death or personal injury caused by negligence, or your mandatory consumer rights.
12. Changes to these Terms
We may update these Terms — for example to reflect changes to the service or the law. The “last updated” date above will change. Material changes affecting active subscribers will be notified by email or in Telegram before they take effect. Continuing to use Cain after that means you accept the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Indonesia. If you are a consumer, you keep the protection of the mandatory laws of your country of residence, and nothing here deprives you of the right to bring proceedings there.
